Cheaper Tomatoes, Strawberries Pose Challenge for Florida

In Florida, however, the opponent is not China and other low-wage Asian nations but the rising tide of cheaper tomato and strawberry imports from Mexico, which have undercut U.S. retail and farm prices.

"They (Mexican growers) produce for the U.S. markets," said John VanSickle, an agricultural economist at the University of Florida in Gainesville who specializes in international trade issues, including tomatoes and strawberries. "The premium product goes to the U.S., and the rest stays in Mexico. If they don't have a U.S. market, they don't have a business."

Mexican strawberry imports showed the steepest rise in the last five years, jumping 142 percent from 2008 to 2011, according to the most recent statistics from the U.S. Department of Agriculture. In the first three quarters of this year, they soared 50 percent compared to the same period in 2011.

Mexican imports will likely rise less steeply in the fourth quarter because farmers in both countries faced many of the same unfavorable growing conditions, said Ted Campbell, executive director of the Florida Strawberry Growers Association in Dover, the industry's trade group.

But that doesn't mean the Mexican market threat has subsided, he said.

"They're not going away. They're going to continue to grow," Campbell said. "You can't ignore what's going on."

Mexican tomato imports have risen significantly but less sharply in the past five years, up 43.7 percent from 2008 through 2011 and another 5.6 percent in the first three 2012 quarters compared with 2011, USDA figures show.

Those numbers reflect Mexican imports of round tomatoes grown in open fields and in "hothouses," or covered areas such as a greenhouse. Those varieties most directly compete with Florida round tomatoes, the dominant variety grown here.

Mexican hothouse tomatoes, which account for about 75 percent of total imports, pose the bigger threat, the federal data shows. They've risen 74 percent from 2008 through 2011.

"In the last five to six years, Mexico has converted from a field culture to a hothouse culture," VanSickle said.

That trend will continue, he added. Among the factors fueling the transition are better prices and lower production costs, including pesticides, which appeals to U.S. consumers concerned about chemical residues on produce.

The smaller percentage growth in imports simply reflects the fact that Mexican tomatoes have been competing in the U.S. market for decades longer.

ALLEGATIONS OF DUMPING

Even at the time of the 1994 North American Free Trade Agreement (NAFTA), Mexican tomatoes had a roughly 40 percent share of the U.S. market, said Reggie Brown, chief executive of the Maitland-based Florida Tomato Exchange, the industry trade group.

Now, its share has grown to about 50 percent currently, and continues to climb.

Florida currently has a 40 percent annual share of the U.S. market for fresh, field-grown, round tomatoes, he said, and it supplies virtually all of the domestic market in that category between December and May.

Mexican competition has sent Florida's tomato acreage down by more than 26 percent in the past decade, from 43,500 acres in the 2001-02 season to 32,000 in 2010-11, according to USDA. Brown estimated the current total at about 30,000 acres.

"It's almost entirely due to Mexican imports," said Tony DiMare, vice president of DiMare Fresh Inc., a national produce company and one of the top three U.S. tomato growers and shippers. DiMare works at the company's Apollo Beach packinghouse.

Florida tomato growers and their counterparts in other states accuse their Mexican counterparts of illegally dumping tomatoes in the U.S., or selling them at prices below the cost of production. The strategy attempts to eliminate competitors to eventually gain control of an entire market.

U.S. growers made the same charge in 1996, two years after NAFTA's enactment.

The U.S. Commerce Department, fearful the complaint would destroy the trade pact, negotiated an agreement with Mexican producer known in the industry as the "suspension agreement" because it suspended action on the dumping complaint, DiMare said.

The suspension agreement was supposed to eliminate surges of imported Mexican tomatoes to maintain stable market prices, he said.

"In my opinion, the Commerce Department failed miserably," in enforcing the agreement, said DiMare, citing the recent Mexican import growth.

U.S. growers have asked the Commerce Department to drop both the suspension agreement, scheduled to expire in January, and the 1996 dumping action. A decision on both is expected by February, Brown said.

Rulings in favor of U.S. tomato growers would allow them to proceed with a new dumping complaint, widely expected to happen.

BATTLING STRAWBERRIES

Mexican imports had their biggest effect on the U.S. tomato and strawberry markets during the 2011-12 season, when a flood of both commodities sent prices plummeting, Campbell and DiMare said.

Farmers in Florida and Mexico lost money last season because of depressed prices, they said.

"We had such depressed prices last year, we couldn't recover our picking, packing and transportation costs," DiMare said. "They (Mexican growers) inundated their own market. They absolutely destroyed the U.S. market."

Wholesale strawberry prices a year ago fell to $7 per flat, or the break-even point, by Christmas, Campbell and growers reported earlier. They recovered briefly in January but sank again the following month.

Because of lower volumes, wholesale strawberry prices returned to a normal levels this season, USDA figures show. Prices averaged about $26 per flat in early December, when Florida is the exclusive domestic strawberry producer, and were about $17.50 on Thursday.

Florida strawberry growers generally harvest until March, when California production ramps up, sending wholesale price below the break-even point.

The significance of the Mexican competition is that its growers compete in the same market windows traditionally dominated by Florida tomato and strawberry growers. Leaders in both commodities view Mexico as a continuing threat.

"If we have seasons like we had last year, where import volumes kept prices so low and made it impossible to sell at a profit, this industry can't maintain those types of losses," Brown said.

NEW GROWING METHODS

The state's tomato and strawberry growers can compete with Mexico, VanSickle said, but both will have to transition to newer technologies.

In both cases, that would include following their Mexican competitors by turning to "covered agriculture," he said. That would include growing in traditional greenhouses or other closed environments, such as large plastic tunnels put up over an entire crop row.

VanSickle, who consults for Florida tomato growers, has delivered that message to industry leaders without much effect, he said.

DiMare and Brown agreed the Florida climate makes covered agricultural production unworkable and the costs "prohibitive," particularly in the current profit environment.

The price to build a one-acre greenhouse, including temperature controls, would run about $1 million, Brown said.

An acre of plastic tunnels over strawberries would cost $30,000, Campbell said, and all could be blown away with a single hurricane or tropical storm.

VanSickle acknowledged a transition would come with big up-front costs, but he maintained growers, particularly tomato growers, could recover by supplying a better product that would fetch a higher market price.

"In this era, consumers are willing to pay more for a better-tasting tomato," VanSickle said.

"If they want to compete, they've got to change the way they're doing business."

Argentina asking court to revert order on debt holdouts

BUENOS AIRES, Argentina ? Argentina is asking a US appeals court to reverse an order for the country to pay $1.33 billion to "holdout" creditors who refused to join two swaps for the country's defaulted debt.

Argentine government lawyers said in papers filed late Friday that the order violates the country's sovereignty. The lawyers said the order also threatens service on at least $24 billion of the county's restructured sovereign debt, impairs the rights of third parties and puts global debt markets at risk.

"The Amended Injunctions have no basis in law, are inequitable, and threaten to wreak havoc on countless innocent third parties, which have already suffered losses due to the plunge in their bonds' value provoked by the insecurity that the Amended Injunctions have created in the market for Argentina's New York law-governed bonds," the briefing said.

"This harm to private and sovereign creditors, as well as to New York law and New York as a place to do business, will only grow if the Amended Injunctions are affirmed. "

The US 2nd Circuit Court of Appeals in New York ordered the country on Oct. 26 to pay the holdouts an equal amount whenever it makes payments on other debt that has been restructured since the country's economic collapse 11 years ago.

It agreed with US District Judge Thomas Griesa, who ruled that with more than $40 billion in foreign reserves, Argentina can afford to pay. The ruling gave Argentina a difficult choice: pay all bondholders equally, or pay none of them and risk going into default.

The court then returned the case to Griesa who ordered Argentina to pay the $1.33 billion into escrow for holders of its defaulted debt and banned banks and other third parties from intervening. Griesa based his ruling on the principle of "pari passu," or equal footing, which says debtors can't pick and choose between creditors.

President Cristina Fernandez called Griesa's ruling "judicial colonialism," and Argentina sidestepped the impending economic chaos when the order was suspended by the appeals court on Nov. 28.

But just the threat of the payment deadline set by Griesa had harsh outcomes. In the week after he issued his order, the cost of maintaining Argentina's overall debt soared in trading on U.S. and European bond markets and the cost of insuring those debts spiked.

"A court can arguably enjoin a foreign state from engaging in a commercial activity within the United States. But it cannot issue an order to force or preclude a foreign sovereign to act or not act within the limits of that sovereign's own territory," Argentina's brief said.

Of course, these plans may not be right for all employers, and they must be drafted to meet ERISA re??quire??ments. Under certain circumstances they can create a significant incentive for employees not to compete after they leave the company.

Yes Virginia, sooner or later we will all be paying more taxes ...

My previous post dealt with two ?surprise? taxes buried in the new Affordable Care Act regulations.? And for the past year, observers have been listing the plethora of new taxes scheduled to take affect in 2013, fiscal cliff or no fiscal cliff.

But that isn?t the whole story.? Far from it, in fact.

All that you need in order to understand what I?m about to explain, is a little math.

Ready?

Since the end of WWII, total annual Federal tax revenues have stayed at around 18% ? 19% of annual GDP.? That includes the years where the top marginal income tax rate exceeded 90% of adjusted gross income. ? During the same period, the Federal government has spent an average of 18% ? 20% of annual GDP.? This includes both the Cold War years, where defense spending alone often exceeded 10% of annual GDP, and the post-Great Society years, where entitlement spending routinely exceeded 50% of the total Federal budget.

The result was a rough balance between receipts and outlays, with a manageable annual deficit of around 1% ? 2% of annual GDP.? But the Obama Administration has significantly altered the former status quo.? Federal tax revenue for 2012 is projected to be around $2.47 trillion, or roughly 17% of projected GDP.? Meanwhile, Federal spending for 2012 comes in at around $3.7 trillion, or roughly 24% of projected GDP.? The Obama Administration originally justified drastically increased spending as a remedy for the ailing post housing bubble economy.? But the inflated spending of 2008 ? 2009 has become the new budget baseline, with annual Federal government spending projected to rise to $4 trillion and beyond, in the next decade.

Of course this creates an enormous problem ? massive annual budget deficits in excess of $1 trillion.? We can?t continue to borrow this amount of money indefinitely.? The revenue from tax increases already slated for 2013 and beyond will be largely consumed by the Federal government?s take-over of the health care industry.? And even if income tax rates are increased for ?the rich,? the revenue raised from these increases will be insignificant compared to the size of our projected annual budget deficits.

So how will the government close the massive 5% ? 7% gap (relative to GDP) between Federal outlays and receipts?? Right now, it seems unlikely that the Federal government will voluntarily reduce spending back to a level that corresponds with 20% of annual GDP.? Another option would be solid economic growth that would rapidly expand our annual GDP and reduce the current Federal spending level back to the 20% range.? But our current anemic rate of economic growth, combined with Obama Administration rhetoric and policies focused on denigrating and punishing successful investors and businesses, makes such a scenario seem like nothing more than wishful thinking.

The remaining option, and obviously the most appealing route for money and power-hungry government officials, is tax increases.? But don?t look for them to be in the form of hikes in traditional income tax rates.? The current arguments over income taxes are nothing more than a smoke screen, a distraction that is easy fodder for pundits, bureaucrats, and Facebook meme-spreaders.? Right now, behind closed doors, DC power players are planning the real taxation strategy: various cleverly packaged tax increases that will affect all tax payers, and that can be sold to a gullible public through arguments about fairness and equality.

The primary tools for drastically increasing tax revenue will certainly include the elimination of significant existing tax exemptions and deductions.? One such item already being targeted is employee health care benefits, which are currently exempted from taxable income:

Workers pay no income or payroll taxes on what their employer contributes for health insurance, and in most cases on their own share of premiums as well.

It?s the single biggest tax break the government allows, outstripping the mortgage interest deduction, the deduction for charitable giving and other better-known benefits. If the value of job-based health insurance were taxed like regular income, it would raise nearly $150 billion in 2013, according to congressional estimates. By comparison, wiping away the mortgage interest deduction would bring in only about $90 billion.

?If you are looking to raise revenue to pay for tax reform, that is the biggest pot of money of all,? said Martin Sullivan, chief economist with Tax Analysts, a nonpartisan publisher of tax information.

Another area of interest involves the IRA, 401(k), and 403(b) tax-deferred retirement savings plans.? Pundits have already noted that these plans add a ?tax expenditure? to existing tax revenue streams that amounts to around $240 billion per year.? A recent study of Denmark?s similar tax-deferred retirement savings plan found that total retirement savings increased by only 1% of the total money given in government tax breaks.? Conclusion: these tax deferments are a huge waste of much-needed money.? And the class warfare argument is also taking shape.? According to the Tax Policy Center, most of the substantial savings available with tax-deferred retirement savings plans are enjoyed only by the top 20% of wage earners.

We should expect to see this issue discussed more frequently in the coming months, with an emphasis restricting or eliminating tax-deferred contributions (particularly for high income earners) or taxing annual growth in retirement accounts as regular income.

There is also another option, favored by an increasing number of DC bureaucrats ? abolishing tax deferred retirement plans, and replacing them with a government-managed retirement plan funded by mandatory contributions from all wage-earners.? New School for Social Research professor of economics Teresa Ghilarducci has already discussed how such a scheme might work:

  • The Federal government sets up a retirement account for all working Americans
  • Funds from workers? existing retirement accounts ? IRA?s, 401(k)?s, 403(b)?s, etc. ? are transferred to these new accounts and converted into Treasury bonds
  • Workers will be required to make a mandatory contribution (say, 5%) to these accounts from each paycheck, with the money converted into Treasury bonds yielding 3% interest plus an adjustment for inflation
  • In lieu of the tax savings realized from traditional tax deferred retirement plan contributions, workers will receive an annual tax credit (say, $600)
  • Upon retirement, workers will receive a monthly payout from this retirement account in addition to Social Security

If you?re scratching your head right now, you should be.? What you just read is a plan to convert real money ? your money ? into government IOU?s, camouflaged by the notion that you are investing in a kind of government-managed annuity.? We should all keep a very close eye on this scheme, because with over $10 trillion currently invested in IRA?s, 401(k)?s, and other tax deferred retirement accounts, the temptation for the Federal government to raid our retirement piggy banks is simply too great.

Finally, we should expect a renewed discussion of the Value Added Tax (VAT).? Put simply, the VAT is an incremental tax, levied in stages on a product, based on formulas that derive the amount of ?value? added to the product (or its components) at each stage of production.? The VAT is figured into the wholesale cost of materials or products at each stage of production, with manufacturers or distributors each paying the tax corresponding to the value that they have added, minus an allowance for the VAT already paid by entities who have previously handled the products or materials.? When the product is offered for retail sale, its price reflects the cost of the VAT that has been added.? Ideally, VAT rates are adjusted so that the final cost of the product including the VAT will be equivalent to the cost of the same product plus a traditional retail sales tax.

Proponents of the VAT argue that since it has very few exemptions and is calculated in a very straight-forward manner, the VAT is a much simpler and far more lucrative revenue tool than traditional sales or income taxes.? But the VAT can only be a preferable alternative to retail sales taxes if it is offered in their place.? Would a new Federal VAT replace existing sales taxes?? Probably not, since most of our existing sales taxes are levied by state and local governments to help fund their respective costs.? Nor would it replace income taxes.? Economist Robert Samuelson believes that a Federal VAT simply isn?t feasible without corresponding Federal spending cuts:

Applied to all consumption spending?about 70 percent of GDP?the required VAT rate would equal about 8 percent. But the actual increase might be closer to 16 percent because there would be huge pressures to exempt groceries, rent and housing, health care, education, and charitable groups. Together, they?re nearly half of the $10 trillion of consumer spending. There would also be other upward (and more technical) pressures on the VAT rate.

Does anyone believe that Americans wouldn?t notice 16 percent price increases for cars, televisions, airfares, gasoline?and much more?even if phased in? As for a VAT?s claimed benefits (simplicity, promotion of investment), these depend on a VAT replacing the present complex income tax that discriminates against investment. That?s unlikely; the needed VAT rates would be implausibly steep. Chances are, we?d pay both.

Higher consumer prices from the VAT could also slow the economy. The Federal Reserve would face policy dilemmas. If it tried to prevent businesses from passing the tax along to consumers, it would have to raise interest rates and risk a recession. If it tried to blunt the effect of higher prices on spending, its easy-credit policy might trigger a new wage-price spiral.

? A VAT might be the least bad tax, though my preference is for energy taxes. But what?s wrong with the simplistic VAT advocacy is that it deemphasizes spending cuts. The consequences would be unnecessarily high taxes that would weaken the economy and discriminate against the young. It would become harder for families to raise children. VAT enthusiasts need to answer two questions: What government spending would you cut first? And how high would your VAT rates go?

Even if we succeed in balancing future Federal budgets with additional tax revenues, we will be living in a very different nation; a nation with a vastly expanded Federal government that consumes 25 cents out of every dollar that its economy creates.? In other words, a nation with a noticeably diminished private sector, and thanks to ever-increasing regulation, a nation with significantly diminished liberties.? Despite the attempts by big-government supporters to dismiss these changes, I believe that an increasing number of Americans will begin to grasp their significance, once they have become noticeably impacted by the government?s encroachment on their lives.? The road ahead looks like a very difficult and costly one for the American taxpayer.

Retailers pull stocks lower on poor holiday sales

NEW YORK (AP) ? For the stock market, this week hasn't been the most wonderful time of the year.

U.S. stocks fell Wednesday for the third trading day in a row. Disappointing holiday sales weighed heavy on retail companies, and the unwelcome "fiscal cliff" package of higher taxes and lower government spending loomed nearer.

The Dow Jones industrial average slipped 24.49 points to 13,114.59. The Standard & Poor's 500 index fell 6.83 to 1,419.83 and the Nasdaq composite lost 22.44 to 2,990.16.

Karyn Cavanaugh, market strategist with ING Investment Management in New York, wrote a note to clients Wednesday highlighting the less-than-merry retail sales.

"I hope that they're reading this from the mall," she said later, "because retail sales could use a boost."

The MasterCard Advisors SpendingPulse report found that sales of electronics, clothing, jewelry and home goods increased just 0.7 percent in the two months before Christmas compared with the same period last year.

That was well below the 3 to 4 percent that analysts had expected and the worst performance since 2008, when spending shrank during the depths of the Great Recession.

Major U.S. retailers including Abercrombie & Fitch, Sears Holdings, Urban Outfitters, Limited Brands, Nike and Gap were all down. Handbag maker Coach, a bellwether of the luxury market, plummeted $3.39 to $54.13. It lost nearly 6 percent of its value, more than any other company in the S&P 500.

Right behind it was online retailer Amazon.com, which helps analysts get a read on the entire retail market. It lost nearly 4 percent, falling $9.99 to $248.63.

Plodding retail sales are a concern because consumer spending accounts for roughly 70 percent of the U.S. economy. When shoppers pull back on spending, that can take a chunk out of company earnings, which in turn pushes down the stock market.

The retail numbers are also a sign that despite scattered hints of an improving economy, including a report Wednesday about rising home prices, many consumers remain uneasy about their prospects.

"Consumers just aren't confident," said Jeff Sica, president and chief investment officer of SICA Wealth Management in Morristown, N.J. "They don't feel a sense of security that they're going to be able to maintain their job or their income or their savings."

Sica pointed out that normally the market rises at this time of year ? the so-called Santa Claus rally. Since 1969, stocks have risen an average of 1.6 percent over the last five days of December and the first two of January, according to The Stock Trader's Almanac.

This year, it seems, the retail sales and "fiscal cliff" have been too much of an overhang.

The "fiscal cliff" refers to lower government spending and higher taxes that will kick in Jan. 1, if Republicans and Democrats can't agree to a new budget by then.

The Senate is due in session Thursday, and President Barack Obama is expected to return early from his Christmas vacation in Hawaii, arriving back in Washington early Thursday. Still, congressional officials said Wednesday they knew of no significant strides toward a compromise over the long Christmas weekend, and no negotiations have been set.

It's not clear that the market would automatically rise if there is a deal, or automatically fall if there isn't. Except for the past three days, the market has risen more or less steadily since mid-November despite the lack of a "fiscal cliff" deal. That means many traders have been assuming that lawmakers would work out something before the deadline, so any positive effect from a compromise is already baked into stock prices.

While a compromise is still possible, some analysts said that what the market feared most wasn't the cliff, but the possibility that lawmakers would come up with only a stop-gap solution. That would probably mean they'd have to meet again in the new year to hammer out a permanent deal, dragging out the uncertainty.

"It's like ripping the Band-Aid off now versus later," Cavanaugh said. "The Band-Aid's got to come off. We've got to cut spending, we've got to pay down the debt."

The bright spot was a report from the Standard & Poor's/Case-Shiller national home price index, which said that home prices rose in most major U.S. cities in October compared with a year ago. However, prices fell in many cities compared to the month before.

The yield on the benchmark 10-year Treasury note edged down to 1.75 percent from 1.77 percent Monday, a sign that investors were taking money out of stocks and putting it into bonds.

It was the first trading day after the Christmas holiday. Trading volume was low, and European markets were still closed.

Just 2.3 billion shares were traded on the New York Stock Exchange. For the year so far, the average has been around 3.6 billion.

Study examines overuse of ambulatory health care services in ...

An analysis of nationally representative survey data found significant improvement in the delivery of underused care, but more limited changes in the reduction of inappropriate care in ambulatory health care settings between 1998 and 2009, according to a report published Online First by Archives of Internal Medicine, a JAMA Network publication.

?Given the rising costs of health care, policymakers are increasingly interested in identifying the inefficiencies in our health care system,? the authors write as background. ?The objective of this study was to determine whether the overuse and misuse of health care services in the ambulatory setting has decreased in the past decade.?

Minal S. Kale, M.D., with Mt. Sinai School of Medicine, New York, and colleagues conducted an analysis using data from the 1998, 1999, 2008 and 2009 National Ambulatory Medical Care Survey (NAMCS) and the outpatient department component of the National Hospital Ambulatory Medical Care Survey (NHAMCS), both of which are nationally representative surveys conducted annually by the Centers for Disease Control and Prevention?s National Center for Health Statistics.

The study sample included 79,083 and 102,980 unweighted visits by adult patients at least 18 years of age in 1998 to 1999, and 2008 to 2009, respectively. Compared with visits made in 1998-1999, visits in 2008-2009 were by slightly older patients (average age 54.2 years vs. 50.9 years), and more patients were insured by Medicare.?

The authors found a statistically significant improvement in six of nine underuse quality indicators, including improvement in use of antithrombotic therapy for atrial fibrillation; use of aspirin, ?-blockers, and Statins in coronary artery disease; use of ?-blockers in congestive heart failure; and the use of Statins in diabetes mellitus.

The authors also observed improvement in two of 11 overuse quality indicators, which included a statistically significant decrease in cervical cancer screening among women older than 65 years, as well as a reduction in the overuse of antibiotics for asthma exacerbations. However, there was an increase in one overuse indicator, prostate cancer screening in men older than 74 years. The authors observed no changes in the other eight quality indicators during the study period.

?In our examination of ambulatory care in the United States, we found an improvement in most of the underuse measures but limited changes in the delivery of inappropriate care,? the authors conclude. ?Developing clinical practice guidelines that define when care should not be delivered and performance measures to address inappropriate care are critical steps to advance the mission of increasing the value and efficiency of health care delivery.?

Postal inspectors say Lacey?s investment scam cost over 200 people over $9 million.

Authorities say Lacey used his position as a former police officer to cheat those around him.

?Mr. Lacey was highly-regarded in the community. The people he solicited from were people he knew very well based on his reputation,? Newman said.

Amazon Gives Netflix Nasty Holiday Gift - Business Insider

Netflix went down last night and Amazon's cloud was to blame, according to a lot of tweets sent out by @Netflixhelps.

Netflix said users across the U.S. were affected.

"There is a partial outage that impacts some, but not all devices that can stream from Netflix. Our teams are working hard, with Amazon Web Services, to address the issue and hope to have streaming available for everyone again soon," Netflix tweeted.

Amazon's competing movie streaming service, Amazon Prime, was not affected by the outage. It was working just fine.

Amazon was experiencing trouble at its infamous East Coast, North Virginia data center, according to its status page. The popular North Virginia data center is implicated in a lot of Amazon outages.

Amazon is far-and-away the leader in cloud computing but it doesn't have the best reputation for uptime.?

Interestingly, Amazon recently showcased its partnership with Netflix at is first-ever user conference last month.? Netflix CEO Reed Hastings, a vocal critic of Amazon Prime, even appeared on stage for a keynote where he said that by the end of 2013, he wants Netflix to be 100% hosted on Amazon's cloud. He expected Netflix to be the biggest business entirely hosted on AWS apart from Amazon's own retail operations.

That's an interesting business strategy, to rely completely on your biggest competitor.
